Please read this Terms of Service (“Terms,” “Terms of Service”) carefully before using the www.nrtrainingroup.com website (the “Website”) operated by Natural Resources Training Group (NRTG), a(n) Limited Liability Company formed in British Columbia, Canada (“us,” “we,” “our”) as this Terms of Service contains important information regarding limitations of our liability. Your access to and use of this Website is conditional upon your acceptance of and compliance with these Terms. These Terms apply to everyone, including but not limited to visitors, users and others, who wish to access and use the Website.

By accessing or using the Website, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you do not have our permission to access or use the Website.

Student Conduct

NRTG is committed to fostering a safe, inclusive, and supportive learning environment for all students and instructors. To ensure full participation in all in-person and online courses, students must be fit and prepared to engage in course activities responsibly. NRTG welcomes persons with disabilities and encourages open discussion of any specific accommodation needs to support their success. By enrolling, you confirm your readiness to safely and actively participate in the NRTG course.

Age Restrictions

All participants must be a minimum age of eighteen (18) years, at the time of registration to participate in any NRTG course.

Private Contract Deliveries

In cases where the purchaser has contracted NRTG for a Private Delivery, the terms outlined in the signed Service Agreement between NRTG and the Client shall take precedent over Terms outlined below. Clients are encouraged to carefully review their Service Agreement for applicable terms.

Registration Confirmation

Participants will receive an email confirming their registration. The registration confirmation email details: course delivery, date, location and personal protective equipment (PPE) requirements. It is the participant’s responsibility to carefully review the information provided and report any discrepancies to NRTG

  • Successful registration for our courses or services provides participants with:
  • Admittance to the course, as specified in the confirmation email
  • Support from NRTG throughout the learning experience
  • A course manual (where applicable)
  • Certificate of completion (providing completion requirements are met)

All NRTG courses include mandatory attendance requirements. Some NRTG courses also include a required classroom or field-based Knowledge Evaluation or Skills Completion Checklist.

Pricing

All prices are listed in Canadian Dollars, unless otherwise specified.

We offer services on this Website. The price of these services can be found listed on the Website. The course price includes applicable taxes and administrative fees. However, it does not cover expenses such as:

  • Expenses relating to a participant’s travel to/from or during course delivery
  • Transport during a course delivery (participants are always required to provide their own transportation)
  • A participant’s Personal Protective Equipment (PPE)
  • Any required participant supplies (e.g., pens, paper, etc.) Note: varies by course. Please refer to the applicable course description
  • Accommodation
  • Meals

NRTG reserves the right to change pricing and/or offer discounts on its services at any time. Terms of Service for each discount will be outlined on all related promotional materials.

Billing and Payments

You shall pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. All payments are due in advance of the course start date. Failure to pay in advance will result in your registration being cancelled.

You hereby represent and warrant that you have the legal right to use the payment method(s) in connection with any purchase and that the information that you supply to us is true, correct and complete.

When you make a purchase via credit or debit card on the Website, you will be using a third-party payment processor, Stripe, that will collect your payment information and process your payment. Please refer to Stripe’s Privacy Policy for details on how your payment data is handled. We are not responsible for the collection, use, sharing or security of your billing information by Stripe. The following payment method(s) are accepted by the third-party payment processor: American Express, MasterCard, and Visa.

To pay via invoice, you must email us (info@nrtraininggroup.com) with the following information:

  • Company or community Name and Address
  • Name and Email of the person responsible for paying the invoice
  • Name, Date and Location of the course you are registering for
  • Names and Emails of any person taking the course
  • If applicable to your company or community, please include a PO number and/or CRA tax exemption letter

Invoices are payable via direct deposit, Interac E-transfer, cheque, or credit/debit card. A $50 fee will be charged for all non-sufficient funds cheques.

Cancellations and Refunds

We offer refunds on purchases made of the services offered on our Website. To qualify for a refund, you must submit your request to us anytime after your purchase by contacting us via email (info@nrtraininggroup.com). We are only able to accept cancellations in writing, via email. Your cancellation and associated refund will be calculated as follows:

  • If NRTG receives notice 14 or more days prior to the scheduled training course start date – NRTG will refund 100% of course registration fees (including taxes)
  • If NRTG receives notice between 7-14 days prior to the scheduled training course start date – NRTG will refund 50% of course registration fees (including 50% of applicable taxes)
  • If NRTG receives notice less than 7 days prior to the scheduled training course start date – NRTG will refund 0% of course registration fees

Refunds are processed to the original payment method within 7-10 business days.

If applicable, credit card payment and refund processing fees of 3.5%* of the original course fee will be applied.
* Or current rate at time of cancellation request.

We reserve the right to cancel your purchase for any reason, at our sole discretion, including but not limited to fraud, inaccuracies, and unavailability of the items or services purchased. We will let you know immediately if we plan on cancelling your purchase.

Transfers

Purchases of the services offered on our Website are transferrable. To transfer your purchase to an alternate delivery or person, you must submit your request to us via email (info@nrtraininggroup.com).

To transfer your purchase to another person, NRTG requires notice of 7 or more days prior to the scheduled training course start date

To transfer your purchase to another delivery (e.g. a future date, or different location), NRTG requires notice of 14 or more days prior to the scheduled training course start date

We reserve the right to transfer your purchase for any reason, at our sole discretion, including but not limited to unavailability of the items or services purchased. We will let you know immediately if we plan on transferring your purchase.

Delays

Delays in, or failure of, performance by either party shall not constitute default or give rise to a claim for damages if and to the extent caused by an occurrence beyond the control of the party affected, including but not limited to a decree of government, natural disaster, fire, flood, storm, or power or communications failure, war, riot, or act of terrorism, and strike (including illegal work stoppage or slowdown) or lockout.

Lifetime Access

The purchase of any NRTG course includes free, lifetime admission (“Lifetime Access”). Lifetime Access allows the participant to return to the course materials or attend a future delivery at no added cost. Course materials include but are not limited to online modules, handbooks, manuals, slides, and identification guides.

  • The benefit of Lifetime Access is granted with the following terms:
  • Lifetime Access is only applicable to the course purchased
  • Lifetime Access is not transferrable to any other NRTG course, or to any other provider of the same course
  • NRTG will grant participants Lifetime Access to their purchased course and associated materials for as long as NRTG offers the course. Should NRTG retire the course, access to the course and associated materials will no longer be available to previous participants
  • Lifetime Access holds no monetary value. It is not redeemable for any sum

NRTG reserves the right to deny or rescind Lifetime Access from any purchaser, at any time.

Accounts and Membership

When you create an account on our Website, you guarantee that you are 18 years of age or older and that the information that you provide us is accurate, complete, and current. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Website.

If you create an account on the Website, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it. We may monitor and review new accounts before you may sign in and start using the Services. You must immediately notify us of any unauthorized uses of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill. If we delete your account for the foregoing reasons, you may not re-register for our Services. We may block your email address and Internet protocol address to prevent further registration.

You can terminate your account by contacting us.

User Content

We do not own any data, information or material (collectively, “Content”) that you submit on the Website while using the Service. You shall have sole responsibility for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use of all submitted Content. We may, but have no obligation to, monitor and review the Content on the Website submitted or created using our Services by you. You grant us permission to access, copy, distribute, store, transmit, reformat, display and perform the Content of your user account solely as required for the purpose of providing the Services to you. Without limiting any of those representations or warranties, we have the right, though not the obligation, to, in our own sole discretion, refuse or remove any Content that, in our reasonable opinion, violates any of our policies or is in any way harmful or objectionable. Backups

We perform regular backups of the Website and its Content and will do our best to ensure completeness and accuracy of these backups. In the event of the hardware failure or data loss we will restore backups automatically to minimize the impact and downtime.

Remedies

You agree that the remedies for breach of this Terms of Service as it relates to your purchase shall be:

  • price reduction;
  • reject the goods, services or digital products;
  • Credit or transfer to an alternative course..

You also agree that the remedy for breach of this Terms of Service as it relates to your purchase shall be to pursue dispute resolution as provided in the “governing law, severability, dispute resolution, venue and class action waiver” section below. These remedies intended to be your sole and exclusive remedies for any breach of this Terms of Service as it relates to your purchase.

Prohibited uses

You agree that you will use this Website in accordance with all applicable laws, rules, regulations and these Terms at all times. The following is a non-exhaustive list of prohibited uses of this Website. You agree that you will not perform any of the following prohibited uses:

  1. Impersonating or attempting to impersonate Natural Resources Training Group (NRTG) or its employees, representatives, subsidiaries or divisions;
  2. Misrepresenting your identity or affiliation with any person or entity;
  3. Sending or attempting to send any advertising or promotional material, including but not limited to spam, junk mail, chain mail or any similar material;
  4. Engaging in any conduct that restricts or inhibits any person’s use or enjoyment of the Website, or which, as determined in our sole discretion, may harm us or the users of this Website or expose us or other users to liability;
  5. Using the Website in any manner that could disable, overburden, damage or impair the Website or interfere with another party’s use of the Website;
  6. Using any robot, spider or other similar automatic technology, process or means to access or use the Website for any purpose, including monitoring or copying any of the material on this Website;

Governing law, severability, dispute resolution and venue

These Terms shall be governed and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of laws provisions. These terms shall not be governed by the United Nations convention on contracts for the sale of international goods, the Uniform Commercial Code, nor Incoterms.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between you and us regarding our Website, and supersede and replace any prior agreements we might have had with you regarding the Website.

Any controversy or claim arising out of or relating to these Terms including but not limited to the interpretation or breach thereof shall be resolved in a court of competent jurisdiction in British Columbia, Canada.
